TERMS AND CONDITIONS OF SALE – E-COMMERCE WEBSITE
These General Terms and Conditions of Sale (GTC) govern the sale of works of art via the website of the Artist Guy Sénécal
hereinafter referred to as “the Seller”, to any buyer, hereinafter referred to as “the Customer”, in France, within the European Union and internationally.
ARTICLE 1 – IDENTITY OF THE SELLER
Guy Sénécal, independent painter. The Seller’s full contact details are provided on the website.
ARTICLE 2 – PURPOSE
The purpose of these T&Cs is to define the conditions under which the Seller offers original works of art (unique pieces or limited editions) for sale online.
ARTICLE 3 – WORKS AND AVAILABILITY
Each work is presented with a detailed description and photographs. Limited-edition works are available whilst stocks last. In the event of unavailability after an order has been placed, the Customer will be informed and refunded without delay.
ARTICLE 4 – PRICES
Prices are quoted in euros (€), inclusive of all taxes (TTC), unless otherwise stated. Delivery costs and any taxes or customs duties outside the EU are specified before the order is confirmed.
ARTICLE 5 – ONLINE ORDER
The order is confirmed when the Customer:
– selects the artwork,
– enters their personal details,
– accepts these Terms and Conditions,
– completes the payment.
Confirmation constitutes contractual acceptance.
ARTICLE 6 – SECURE PAYMENT
Payment is made via the secure payment methods offered on the website (credit card, bank transfer, or other specified methods). The works remain the property of the Seller until full payment has been received.
ARTICLE 7 – DELIVERY The works are dispatched to the address provided by the Customer via a carrier such as UPS or DHL or any other transport provider. The work is insured during transit for the amount paid by the Customer. Delivery times are provided for information only. Particular care is taken with the packaging. The risk is transferred to the Customer upon handover by the carrier.
ARTICLE 8 – SPECIAL CONDITIONS IN EUROPE – RIGHT OF WITHDRAWAL
In accordance with European legislation, private customers have a period of 14 days from receipt to exercise their right of withdrawal. This does not apply to personalised works or those made to order. Return costs are the responsibility of the Customer. The artwork must be returned in perfect condition.
ARTICLE 9 – LIABILITY
The Seller shall not be held liable for indirect damages or delays attributable to carriers.
ARTICLE 10 – INTELLECTUAL PROPERTY
The Artist retains all copyright relating to the artwork. Any reproduction or use without written authorisation is prohibited.
ARTICLE 11 – PERSONAL DATA
The data collected is used solely for the processing of orders and complies with the GDPR (General Data Protection Regulation). The Customer has the right to access, rectify and delete their data.
ARTICLE 12 – GOVERNING LAW AND DISPUTES These Terms and Conditions are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken.
ARTICLE 13 – ACCEPTANCE
The Customer acknowledges that they have read these T&Cs and accept them without reservation.
